The Company has disputed Integrated Goods and Services Tax (IGST) levied by Customs authorities on re-import of aircraft, engines & certain aircraft parts after performing repair outside India. With respect to IGST paid on imports prior to 19 July 2021, the Company has received favourable orders from CESTAT- New Delhi, which were appealed by the Department before the Hon’ble Supreme Court of India. On July 14, 2025 the Hon’ble Supreme Court of India dismissed one (1) out of three (3) pending appeals filed by the Department. Further, the Government vide Notification dated July 19, 2021 amended the customs notification to re-iterate their position that IGST is applicable on re-import of goods after repair. The Company filed a Writ Petition before the Hon’ble High Court of Delhi challenging the constitutional validity of the Amendment Notification. On March 4, 2025 Hon’ble High Court of Delhi pronounced its order, holding that repair and re-import transaction is a supply of service and levy of IGST at the time of re-import of goods repaired abroad is unconstitutional and invalid. Department has filed appeal before the Hon’ble Supreme Court on August 29, 2025 against the order dated March 4, 2025 passed by the Hon’ble High Court of Delhi. The last update in this regard was provided as a part of Integrated filing - Governance submitted for the quarter ended September 30, 2025.
